State Education Department Advises Schools on Rights of Students Displaced by Recent Natural Disasters

Many students in Florida, Texas, Puerto Rico, the US Virgin Islands, and the Caribbean have been displaced due to the numerous hurricanes that impacted these regions. On October 12, 2017, the NY State Education Department issued a memorandum about accepting students who were displaced due to these storms. Schools are required to immediately enroll displaced students even if they cannot produce records normally required in the registration process. This includes students with disabilities. Among other things, the memo discusses:

  • Utilization of existing student IEP’s until such time as the student can be re-evaluated
  • Development of temporary IEP if IEP is not immediately available
  • Expedited variances for over-enrollment for displaced students
